1. Acceptance of Terms

By creating an account or using EcomMail OS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

EcomMail OS is an AI-powered email campaign generation platform that helps e-commerce businesses create professional, conversion-optimised email HTML using large language models. The Service includes campaign generation, AI banner creation, brand intelligence scraping, and related tools.

3. Accounts & Subscriptions

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • Subscriptions are billed monthly or annually as selected. You may cancel at any time; access continues until the end of the current billing period.
  • Campaign credits are allocated monthly and do not roll over to the next billing cycle.
  • Pricing may change with reasonable notice. Existing subscribers will be notified at least 30 days in advance of any price increases.

4. Acceptable Use

You agree not to use the Service to:

  • Generate spam, phishing, or deceptive email content.
  • Violate any applicable laws or regulations, including CAN-SPAM, GDPR, or CASL.
  • Scrape or extract data from the platform beyond normal use.
  • Resell or sublicense access to the Service without written permission.
  • Attempt to reverse-engineer, copy, or replicate the underlying AI systems or prompts.

5. AI-Generated Content

EcomMail OS uses AI models (Google Gemini, Anthropic Claude) to generate content. You retain ownership of the final output you produce, but you acknowledge that:

  • AI-generated content should be reviewed before sending to subscribers.
  • We do not guarantee the accuracy, completeness, or fitness of AI-generated copy for any specific purpose.
  • You are responsible for ensuring all campaigns comply with your local email marketing laws and your ESP's terms.

6. Intellectual Property

The EcomMail OS platform, including its design, code, prompts, and branding, is our intellectual property. You may not copy, modify, or distribute any part of the platform without explicit written consent.

7. Limitation of Liability

To the maximum extent permitted by law, EcomMail OS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost revenue, lost data, or business interruption. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.

8. Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse the Service. You may delete your account at any time from your account settings.

9. Governing Law

These terms are governed by the laws of Romania. Any disputes shall be resolved in the courts of competent jurisdiction in Romania.
